What Rapid Scan covers. A Rapid Scan is researched from public sources and any material you supply. It is for information only and is not investment, legal, tax or engineering advice. Rapid Scan does not include Deal Structuring Advisory. That is a separate AfriLens service, scoped and quoted separately under its own engagement letter and terms, and this policy does not apply to it.
This policy forms part of our Terms of Sale and applies together with our general Refund Policy. It gives every Rapid Scan customer the same remedies. Nothing in it limits any right you have under the Consumer Protection Act 68 of 2008 ("CPA") or the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") that the law does not allow us to exclude.
Part A: Late delivery
1. Our delivery commitment. Our research team will email you your Rapid Scan within 5 working days. The 5 days start on the later of two dates: (a) the day your payment clears, and (b) the day we have your complete brief. Your brief is complete once you have submitted the scope form, it has passed our scope check, and you have answered any clarifying questions we sent within 1 working day of your order. Working days are Monday to Friday, excluding South African public holidays. We confirm your due date by email (the "Delivery Date").
2. Capacity and start dates. We take up to 2 Rapid Scan orders per week (Monday to Sunday), counted by start date. If the current week is full, checkout shows the next available start date before you pay. We offer start dates up to 4 weeks ahead. If you order for a later start date, the 5 working days run from that date, or from the later of cleared payment and a complete brief if that is later. If the start date or the Delivery Date is more than 30 days after your order, we will ask you to accept that date expressly before you pay.
3. If the delay is caused by you. The Delivery Date moves back by one working day for each working day that we wait on you. That covers waiting for answers to clarifying questions, waiting for materials you promised to send, and waiting for you to agree to a change of scope that you asked for. We will tell you the new date in writing. If you do not reply to us for 10 working days, we may either (a) deliver on the information we have, noting any gaps, or (b) cancel the order and refund what you paid, less only the value of work done under Part B, section 3. No administration fee applies in that case.
4. We will tell you early. If we expect to miss the Delivery Date for a reason that is not caused by you, we will email you as soon as we know, and at least 1 working day before the Delivery Date. The email will give the reason, a realistic new date and your options under section 5.
5. Your options if we are late. If we miss the Delivery Date, or tell you we will, you may choose one of these:
- (a) A new date. Accept a revised Delivery Date; or
- (b) A credit. Accept delivery as soon as possible, with a credit of 10% of the fee (R2,500) towards any AfriLens product or service; or
- (c) Cancellation. Cancel the order and receive a full refund for work you have not received. If you have received nothing, that is a full refund of everything you paid.
If you do not choose within 3 working days of our notice, we will continue the work and apply option (a). You can still choose option (c) later if we also miss the revised date. We never deduct an administration fee or the value of work done from a refund caused by our delay.
6. Your statutory rights. If we do not deliver by the Delivery Date, and in any event within 30 days after we receive your order (unless you expressly accepted a later date before paying), you may cancel by giving us 7 days' written notice. If we still have not delivered when the notice period ends, we will refund everything you paid (ECTA section 46). Where the CPA applies to you and we perform late, you may also cancel instead of accepting late performance (CPA section 19). These rights are in addition to section 5. Refunds under this Part are processed as set out in Part B, section 7.
Part B: Refunds
1. Cooling-off and starting work. ECTA section 44 gives online consumers 7 days to cancel without giving a reason. Under ECTA section 42(2), that right does not apply to services that begin, with your consent, before the 7 days end. At checkout we ask you to choose:
☐ I ask AfriLens to start my Rapid Scan straight away. I understand that once work has begun, the 7-day cooling-off period under section 44 of the Electronic Communications and Transactions Act no longer applies. I keep the refund rights in the Rapid Scan Late Delivery and Refund Policy and my rights under the Consumer Protection Act.
The box is never pre-ticked. If you do not tick it, we start work on the 8th day after your order, and the Delivery Date is set from that day. If you cancel during the cooling-off period, we refund everything you paid, with no deduction.
2. Before work starts: full refund. If you cancel before our research team starts work, we refund 100% of what you paid, with no deduction. This includes an order waiting for a later start date because the weekly limit was reached. We will email you when work starts.
3. After work starts, before delivery. If you cancel after work has started but before we deliver, we refund what you paid less (a) the reasonable value of the work already done and (b) an administration fee of 10% of the fee (R2,500). For the value of work done, we keep no more than:
| Stage reached when you cancel | Value of work done (maximum) | | Scoping and source plan done | 15% (R3,750) | | Research underway | 40% (R10,000) | | First version of the study substantially complete | 70% (R17,500) |
With the refund, we will give you a short explanation of the deduction and, if you want it, the work completed so far. If you cancel because of death or hospitalisation, we make no deduction at all (CPA section 17). The administration fee never applies to cooling-off refunds, to refunds caused by our late delivery (Part A) or to refunds for a quality defect (section 5).
4. After delivery and acceptance. Your study counts as accepted when you confirm acceptance or 5 working days after delivery, whichever comes first, unless you have raised a quality concern by then. Once a study is accepted, we do not refund for a change of mind or a change in your needs. Your rights for a quality defect (section 5) still apply.
5. Quality defects. A quality defect means the study does not meet what we agreed or is not of the quality generally expected (CPA section 54). Examples: it does not address your confirmed question, it is materially shorter than 15 pages, it has no verification appendix, or it contains material factual errors or wrong citations. Findings you disagree with, a change to your question, and gaps we flagged because information was not available are not defects. If there is a defect, you choose:
- A fix. We revise the study at no cost within 5 working days of your notice; or
- A partial refund. We refund a reasonable portion of the price that reflects how far the study falls short, up to a full refund if it is materially unusable.
If a fix does not resolve the defect, you may still choose a partial refund. Please raise defects within 14 days of delivery so we can act quickly. Raising one later does not remove your rights under the CPA.
6. How to request a refund. Email [email protected] with the subject "Rapid Scan refund" and your order ID, with a short reason.
- We acknowledge your request within 2 working days.
- We give you a decision within 5 working days.
- We process approved refunds within 10 business days of the decision.
7. How refunds are paid. Refunds go to your original payment method through Gumroad, our payment provider, in rand. Your bank may take a few more days to show the refund. We do not deduct payment-processing fees from any refund. The only deductions are those in Part B, section 3, where they apply.
8. Chargebacks. Please contact us before you dispute a charge with your bank. Most issues can be resolved faster that way. If you do file a chargeback, your legal rights are not affected. We may give Gumroad and your bank your order details, scope, delivery records and correspondence. We may also pause work on the order while the dispute is open. If a chargeback is decided in your favour, we will not refund the same amount a second time.
9. Contact and complaints. Please send any complaint first to [email protected], and we will try to resolve it quickly. If we cannot resolve it and the CPA applies to you, you may refer it to the Consumer Goods and Services Ombud or the National Consumer Commission. Our address is AfriLens Intelligence (Pty) Ltd, 21 Woodlands Office Park, Woodmead.
